2. Legal framework

This policy is issued in compliance with the Political Constitution of Colombia (articles 15 and 20), Law 1581 of 2012, Decree 1377 of 2013, Law 1266 of 2008 and other applicable rules on personal data protection and Habeas Data.

3. Data we collect

The Firm collects only the data required to respond to your enquiry and, where applicable, to provide the professional services engaged:

  • Contact details you provide in the form: full name, phone number with country code, email address, preferred language, area of legal interest and the content of the message you choose to send us.
  • Data arising from the professional relationship: once a matter is formalised, the documents you provide for the procedure (identity document or passport, immigration history, corporate or real estate documents, and others, depending on the case).
  • Browsing data: IP address, browser and device type, pages visited and data obtained through cookies.

The Firm does not request sensitive data or data relating to minors through this website. If your matter makes it necessary to process such categories of data, your express and specific authorisation will be requested beforehand.

4. Purposes of processing

Your personal data will be processed for the following purposes:

  • To handle, answer and follow up on your enquiry or request for advice.
  • To carry out a conflict-of-interest check before accepting a matter.
  • To assess the legal viability of your case and prepare the professional services proposal.
  • To perform the services agreement and carry out the procedures entrusted to us before authorities and third parties.
  • To issue invoices and comply with accounting, tax and legal obligations.
  • To send information about regulatory changes or the Firm’s services, only where you have authorised it.
  • To analyse website usage on an aggregate basis in order to improve it.

Your data will not be sold, assigned or traded to third parties for advertising purposes.

5. Your authorisation

By completing the contact form and ticking the authorisation box, you give your prior, express and informed consent to the processing of your data on the terms of this policy. Authorisation is also understood to be given when you contact us voluntarily via WhatsApp, email or social media to request advice.

6. Your rights (Habeas Data)

As the data subject, you have the right to:

  • Access, update and rectify your personal data.
  • Request proof of the authorisation given, except in the cases exempted by law.
  • Be informed, upon request, of the use made of your data.
  • File complaints with the Colombian Superintendence of Industry and Commerce for breaches of the applicable rules.
  • Withdraw your authorisation and request deletion of your data, where no legal or contractual duty prevents it.
  • Access your processed personal data free of charge.

7. How to exercise your rights

You may exercise any of these rights by writing to Luiszuniga.lawyer@gmail.com with the subject line “Data Protection”, stating your full name, identification document, the right you wish to exercise and the facts supporting your request.

Enquiries are answered within a maximum of ten (10) business days and complaints within a maximum of fifteen (15) business days, extendable as permitted by law, counted from receipt.

8. Attorney–client privilege

Information you provide within a formalised professional relationship is protected by attorney–client privilege, a constitutionally protected and inviolable guarantee under Colombian law. Such information will not be disclosed to third parties, except with your express authorisation or by order of a competent authority in the cases determined by law.

We recommend that you do not send sensitive documents through the contact form before a professional relationship has been formalised.

9. Processors and third parties involved

In order to operate the website and deliver its services, the Firm relies on providers acting as data processors, which may host information on servers located outside Colombia:

  • Web hosting and email provider.
  • Instant messaging services and social networks that you choose to use as a contact channel (WhatsApp, Instagram, LinkedIn), subject to their own privacy policies.
  • Web analytics tools.

In addition, carrying out the procedures entrusted to us may require providing your information to competent authorities and entities (Migración Colombia, the Ministry of Foreign Affairs, notaries, registry offices, chambers of commerce, courts), which is a necessary condition for performing the engaged service.

10. International transfers

Because the Firm serves clients abroad and uses cloud services, your data may be transferred to countries other than Colombia. In such cases, the safeguards required by Law 1581 of 2012 will be applied to ensure an adequate level of protection.

11. Information security

The Firm applies reasonable technical, human and administrative measures to protect your data against unauthorised access, loss, alteration or fraudulent use. You acknowledge, however, that no transmission of information over the internet can be guaranteed to be entirely secure.

12. Data retention

Data from enquiries that do not result in an engagement is kept for as long as reasonably necessary to handle the enquiry and is then deleted or anonymised. Data of engaged clients is kept for the duration of the professional relationship and thereafter for the periods required by accounting, tax and professional liability rules.

13. Cookie policy

This site uses first-party and third-party cookies to remember your preferences, maintain your session, measure traffic and improve your browsing experience. By continuing to browse, you accept their use. You may configure your browser to block or delete them at any time, bearing in mind that this may limit certain features of the site.

14. Minors

The services and this website are intended for adults. Data relating to minors is not knowingly collected. Where a legal matter involves a minor, the data will be provided by their legal representatives and processed with regard to the best interests of the child.
